Mark Dalyell is the principal of MMD Law and is admitted to practice as a solicitor in the Supreme Court of NSW and the High Court of Australia. He has successfully represented clients (including children) in New South Wales District and Local Courts as well as the Family Court of Australia. Mark holds a Bachelor of Arts degree from the University of New South Wales and a Bachelor of Laws degree from the University of New England (Armidale, NSW).

After a career in the finance industry which spanned more than 20 years Mark decided to pursue the career and work that he really wanted - the law, and commenced study for his law degree part-time as a mature age student, whilst working full time. After gaining experience in general practice in the country which included Traffic, Criminal, Family, Property, Wills and Probate law, he returned to live in Sydney.

Mark firmly believes that mutual respect between client and solicitor coupled with a common sense, plain English approach, experience, honesty and integrity are the key ingredients to building a mutually rewarding relationship with his clients. These values coupled with his outgoing and friendly nature allow him to best represent their interests for the best possible outcomes.

Mark had a lengthy career as an Officer in the Army Reserve. He is the presenter of the legal module at the Traffic Offenders Intervention Program conducted by North Sydney PCYC, and he is committed to the principles of social capital and to contributing to the community.

Why choose a lawyer, rather than a conveyancer?

Experienced, qualified lawyers who are familiar with the law applying to buying and selling property in NSW are able to exercise their legal knowledge to protect clients if and when problems occur. Depending on the particular circumstances of a matter clients may be able to terminate or enforce the contract or seek rectification or a reduction in the purchase price.

Why do conveyancing costs vary so much in NSW?

Recently, the practice has developed for organizations to offer heavy discounting for conveyancing services. To do this and remain in business these organizations typically have to resort to delegating as much of the work on a conveyance as possible to unsupervised and/or unqualified staff.
We don't do this at MMD Law.

Vendors and purchasers should not forget that conveyancing is all about the transfer of title from one individual to another. In most cases, solicitor's conveyancing fees for the purchase of a property are more than those for a sale of a property which reflects the increased amount of work and attention to detail required.

Another reason for the variation in fees is the type of title for a particular property. For example, "Torrens" title is the most straightforward title as it is based on title being recorded at a registry while "Old System" is the most complex and time consuming as "good root of title" has to be established based on sometimes very complex documentary evidence. While off the plan purchases are often complex transactions.

Taking the cheapest fee offered can lead to false economy, especially if something goes wrong. Buying or selling a property is often the largest single transaction that many people enter in to. Don't take unnecessary chances and use a qualified solicitor.

Wills & Estates

Estate planning is a term that is used fairly frequently for Wills, Enduring Power of Attorney Enduring Guardianship and Advanced Care Directives.

We are able to assist clients with the preparation of Wills, Enduring Powers of Attorney, Enduring Guardianship and matters relating to estate planning.

If you die without a valid Will, your assets will be distributed according to a government formula. Subject to the provisions of Family Provision chapter of the Succession Act 2006 (Chapter 3) making a Will ensures that your assets will be given those you nominate and that a person who you trust is appointed to carry out your wishes. Nominating an Enduring Power of Attorney and Enduring Guardianship is an important aspect of estate planning.

An Enduring Power of Attorney or Enduring Guardianship is a precautionary safety measure you can put in place in case you are unable to make decisions for your financial or personal and lifestyle affairs in the future. Disputed Estates / Wills - If you have been left out of a Will, or not properly provided for, you may have a claim under the Family Provision chapter of the Succession Act 2006 (Chapter 3).
